Probating Will without Administration

In Indiana, you can file a Petition for No Administration (Spread Will of Record) which allows the will to be probated, preserving the three year limitation in probating a will.   There is generally no filing fee for this procedure, but the original Will and the Petition and Order must be filed in the county of domicile where the person was living.    And the Will must have been executed and witnessed in accordance to Indiana Law to allow it to be probated as a "self-proved" Will.

An executor does not have the authority to act as "executor" until the will is probated.   This is why the statute allows you to probate the will without administration.

I was told that I would need to fill this form out  as well as an order. How would I find them or is this something only an attorney can handle..

There is a Petition for No Administration (Spread Will of Record), which allows one to probate the Will without a filing fee.   Since Wills are void after 3 years if not probated, this Petition and Order with the Orginal Will should be prepared.   I don't know if forms are available, but I can assist you if you email me at attorneyarlene@gmail.com
