3 year limit to probate will 

Is it true that if you do not probate a will within three years from the date of death of someone, you cannot later probate it?

This is true.   If a will is not probated and later assets are found, after 3 years, the assets will pass by intestate law not under the Will.  This is why it is important to Spread the Will of Record, even if you believe there are no probate assets.
